1. Sponsor

The 1 in 10 Orders Free Sweepstakes (the “Sweepstakes”) is sponsored by Shinesty, Inc., 6050 Washington St., Suite 130, Denver, CO 80216 (“Sponsor”). The Sweepstakes is governed by these Official Rules (“Rules”). By entering, you agree to be bound by these Rules and the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes.

2. Eligibility

Open only to legal residents of the fifty (50) United States and the District of Columbia, excluding residents of New York and Florida, who are at least eighteen (18) years of age at the time of entry. Employees, officers, and directors of Sponsor, its parents, subsidiaries, affiliates, and agencies involved in administering the Sweepstakes, and members of their immediate families or households, are not eligible. Void in New York, Florida, outside the United States, and where prohibited or restricted by law.

3. Entry Period

The Sweepstakes begins at 12:00 AM Pacific Time on October 29, 2026 and ends at 11:59 PM Pacific Time on October 30, 2026 (the “Entry Period”). Sponsor’s server clock is the official timekeeping device for the Sweepstakes. Entries received before or after the Entry Period are void.

4. How to Enter

Purchase entry: Place an order on shinesty.com during the Entry Period. Each eligible order placed during the Entry Period is automatically entered using the name and email address on the order. Free entry (no purchase necessary): During the Entry Period, complete and submit the free entry form at shinesty.com/pages/1-in-10 with your first and last name, email address, phone number, and mailing address, and confirm your eligibility and agreement to these Rules. Free entries and purchase entries have identical odds of winning. Entries that are incomplete, illegible, automated, or generated by script, macro, or other mechanical means are void.

5. Limit on Entries

Limit one (1) entry per person and per email address for the entire Entry Period, regardless of method of entry or number of orders placed. If a person submits more than one entry, only the first eligible entry received will be counted and the remaining entries will be void. Attempts to obtain more than the permitted number of entries using multiple identities, email addresses, or addresses will disqualify all entries from that person.

6. Prizes

Purchase-entry prize: A refund of the full amount paid for the winning order, including product, taxes, and shipping, issued to the original payment method. Any discount codes, gift cards, or store credit applied to the order are not refunded in cash; gift card and store credit amounts are returned to the original gift card or credit balance. Free-entry prize: A Shinesty digital gift card with a value equal to the average refund issued to all purchase-entry winners, rounded to the nearest whole dollar, delivered by email. Gift cards are subject to Sponsor’s standard gift card terms and are not redeemable for cash except where required by law. Approximate retail value of each prize varies with the winning order; Sponsor estimates the average prize value at the average order value on shinesty.com during the Entry Period. No cash alternative or substitution except at Sponsor’s sole discretion, in which case a prize of equal or greater value will be awarded.

7. Odds of Winning

One (1) in every ten (10) eligible entries will be selected as a winner. Odds of winning are identical for every eligible entry regardless of method of entry; a purchase, order value, or number of orders does not increase the chance of winning. The total number of prizes awarded depends on the total number of eligible entries received.

8. Winner Selection

Within fourteen (14) days after the end of the Entry Period, Sponsor or its designated administrator will conduct a random drawing from all eligible entries received, selecting a number of winners equal to the total number of eligible entries divided by ten, rounded down to the nearest whole number. Duplicate and ineligible entries are removed before the drawing. The drawing is final.

9. Winner Notification and Verification

Potential winners will be notified by email at the address associated with their entry within fourteen (14) days of the end of the Entry Period. Potential winners may be required to confirm eligibility and, where required by law, sign and return an affidavit of eligibility and liability/publicity release within seven (7) days of notification. If a potential winner cannot be reached, is found ineligible, fails to respond within the required time, or declines the prize, the prize will be forfeited and Sponsor may, at its discretion, select an alternate winner from the remaining eligible entries.

10. Prize Conditions

Refunds are issued to the original payment method within fourteen (14) business days of winner verification; gift cards are emailed within the same period. Prizes are awarded “as is.” Winners are solely responsible for any federal, state, and local taxes on prizes. Prizes are non-transferable. Orders that are cancelled, returned for refund, or subject to a chargeback before the drawing are ineligible; a winning order that is later returned will have the prize value deducted from any return refund.

11. Publicity

Except where prohibited by law, acceptance of a prize constitutes the winner’s consent for Sponsor to use the winner’s first name, last initial, city, and state for advertising and promotional purposes in any media, worldwide, without further payment or consideration.

12. General Conditions

Sponsor reserves the right to cancel, suspend, or modify the Sweepstakes if fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs its integrity or proper functioning, as determined by Sponsor in its sole discretion. If cancelled, Sponsor may select winners from all eligible entries received before the cancellation. Sponsor reserves the right to disqualify any individual who tampers with the entry process, violates these Rules, or acts in a disruptive or unsportsmanlike manner. Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and Sponsor reserves the right to seek damages to the fullest extent permitted by law.

13. Release and Limitation of Liability

By entering, entrants release and hold harmless Sponsor, its parents, subsidiaries, affiliates, and their respective officers, directors, employees, and agents (the “Released Parties”) from any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including without limitation: technical errors; unauthorized human intervention; lost, late, incomplete, or misdirected entries; or any injury or damage to persons or property. The Released Parties are not responsible for incorrect or inaccurate entry information, whether caused by entrants or by equipment or programming associated with the Sweepstakes.

14. Disputes and Governing Law

Except where prohibited, all issues and questions concerning the construction, validity, interpretation, and enforceability of these Rules, or the rights and obligations of entrants and Sponsor, are governed by the laws of the State of Colorado, without regard to conflict of law rules. Entrants agree that any disputes shall be resolved individually, without resort to any form of class action, exclusively in the state or federal courts located in Denver, Colorado. Claims are limited to actual out-of-pocket costs incurred to enter; attorneys’ fees and incidental, consequential, and punitive damages are waived.

15. Winners List and Privacy
